These Terms of Service (hereinafter "Terms") govern the use of the 2GATHER mobile application (hereinafter "Application" or "Service") and the website https://2gather.me (hereinafter "Website"), provided by Nyxus OÜ (hereinafter "we", "us", or "Provider").

2GATHER is a dating platform that redefines online dating by connecting people for real-world meetups. Our approach is simple: no endless chatting – just genuine connections at events organized by verified hosts.

3. Scope of Application

These Terms apply to all users of the Application and Website, including registered users (participants and hosts) as well as visitors to the Website.

By using our services, you acknowledge and agree to comply with these Terms and our Privacy Policy.

4. Description of Services

4.1 For Participants

• Browse events organized by hosts
• Register for events through the Application
• Profile management with photos and personal information
• Private messaging feature with other participants
• Access to photos from past events (uploaded by hosts)

4.2 For Hosts

• Create and manage events
• Manage registrations and participant lists
• Upload photos from past events
• Provide safe and enjoyable gatherings

5. Registration and Account

5.1 Age Requirement

You must be at least 18 years old to register and use our services.

5.2 Registration Obligations

You agree to:

• Provide true and current information
• Keep your account credentials confidential
• Notify us immediately of any unauthorized use of your account

5.3 Identity Verification for Hosts

Hosts must verify their identity by uploading a valid ID document (national ID card or passport). This document is used solely for verification and is immediately deleted after review.

6. Usage Rules

6.1 Prohibited Behavior

It is strictly prohibited to:

• Create fake or misleading profiles
• Publish harassing, offensive, or discriminatory content
• Solicit minors to participate in events
• Engage in fraudulent, illegal, or harmful activities
• Contact other users to promote commercial or advertising purposes outside the platform
• Compromise the security or integrity of the platform

6.2 Host Responsibilities

Hosts agree to:

• Organize events in safe and suitable venues
• Respect the privacy and safety of participants
• Comply with all applicable local laws
• Provide accurate and complete event information (location, date, activities)

7. Moderation and Sanctions

We reserve the right to:

• Moderate content uploaded by users (photos, descriptions, messages)
• Suspend or delete accounts that violate these Terms
• Exclude users from the platform without notice for serious violations (harassment, fraud, illegal behavior)

8. Intellectual Property

All content on the Application and Website (text, images, logos, design) is the exclusive property of Nyxus OÜ and protected by copyright.

By uploading content (photos, descriptions) to the platform, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display this content within the scope of our services.

9. Liability

9.1 User Responsibility

Users are responsible for their interactions and for the events they attend. Nyxus OÜ does not organize events itself and is not liable for:

• Incidents or accidents during events
• Actions or behavior of users outside the platform
• Damages arising from the use of services (except in cases of gross negligence or intent)

9.2 Limitation of Liability

Nyxus OÜ cannot be held liable for direct or indirect damages resulting from the use or inability to use the services, except in cases of proven gross negligence or intent.

10. Confidentiality and Data Protection

The processing of your personal data is detailed in our Privacy Policy, available on the Website and in the Application.

We are committed to ensuring the confidentiality of your data in accordance with the General Data Protection Regulation (GDPR) and applicable data protection laws.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Users will be informed of significant changes via email or notification in the Application.

Continued use of the services after changes take effect constitutes acceptance of the new Terms.

12. Termination

Users can delete their account at any time through the Application settings or by email to privacy@2gather.me.

We reserve the right to terminate an account without notice if a violation of these Terms is detected.

13. Applicable Law and Jurisdiction

These Terms are governed by Estonian law.

In case of disputes related to these Terms, the courts in Tallinn, Estonia, have jurisdiction, subject to mandatory consumer protection provisions.
